Plush Living LLC d/b/a CBD Pillow ("CBD Pillow," "we," "us," or "our") respects your privacy and is committed to handling personal information responsibly and in accordance with applicable law.

This Privacy Policy explains how we collect, use, disclose, retain, and otherwise process personal information when you visit or interact with cbdpillow.com, purchase or consider purchasing CBD Pillow products, communicate with us, review CBD-related content, use customer-service or AI-enabled features, participate in promotions, submit reviews or testimonials, or otherwise use services that link to this Privacy Policy (collectively, the "Services").

It also describes privacy rights that may be available to you. Where applicable law requires consent or another authorization for a particular activity, we will seek that consent or authorization as required.

1. SCOPE

This Privacy Policy applies to personal information processed by CBD Pillow in connection with the Services.

It does not apply to:

2. PERSONAL INFORMATION WE COLLECT

A. Identifiers and Contact Information

This may include name, billing and shipping address, email address, telephone number, account or customer identifiers, IP address, device identifiers, advertising identifiers, cookie identifiers, and similar identifiers associated with your browser, device, account, or interactions with us.

B. Account and Customer Information

This may include account credentials, preferences, customer-service history, warranty information, return and exchange information, account settings, and records concerning your relationship with CBD Pillow.

C. Transaction and Commercial Information

This may include products viewed, considered, or purchased; shopping-cart activity; order history; purchase date and amount; product preferences; shipping and fulfillment information; returns and refunds; warranty claims; discounts or promotions used; financing-related transaction information; and other commercial interactions with CBD Pillow.

D. Payment and Financial Information

When you make a purchase, information may include billing information, transaction identifiers, payment status, and information necessary for payment, financing, fraud prevention, or transaction processing. Full payment-card or financing credentials may be collected and processed directly by third-party payment processors, financial institutions, or financing providers rather than retained by CBD Pillow.

E. Internet, Device, and Electronic Activity

This may include pages viewed, links clicked, products viewed, search activity, referring URLs, browsing and session activity, date and time of visits, interactions with advertisements, cart and checkout events, device type, operating system, browser, IP-derived information, cookie and device identifiers, advertising identifiers, conversion events, and attribution information.

F. Approximate Location

We may infer approximate geographic location from an IP address, shipping address, device information, or similar information. We do not ordinarily require precise geolocation information to purchase CBD Pillow products.

G. Communications and Customer-Service Information

When you communicate with CBD Pillow by telephone, email, SMS, chat, AI-enabled assistant, contact form, social media, or another channel, we may process the contents of the communication; contact information; information concerning your order, account, product inquiry, return, warranty, or service request; date, time, and communication information; customer-service notes; and recordings or transcripts where applicable.

Where permitted by applicable law, calls, chats, or other communications may be monitored, recorded, or transcribed. Where applicable law requires notice, consent, or other authorization before recording, monitoring, or transcription, we will provide or obtain the required notice, consent, or authorization.

Please avoid providing medical, financial, or other sensitive information through customer-service communications unless reasonably necessary for your request. Health-related information voluntarily provided to CBD Pillow may constitute Consumer Health Data and is additionally addressed in our separate Consumer Health Data Privacy Policy.

H. Product Preferences and Recommendation Information

If you use a product-selection or customer-assistance feature, we may collect non-medical information such as sleeping position, comfort preferences, pillow firmness or loft preferences, cooling preferences, product size or quantity preferences, intended frequency of use, and other information used to provide the product recommendation or assistance you request. If you voluntarily provide information concerning CBD use, cannabinoid preferences, tolerance, sleep concerns, pain, stress, medication, treatment, or other health-related matters, that information may constitute Consumer Health Data and is addressed in our separate Consumer Health Data Privacy Policy.

CBD Pillow does not require a medical diagnosis, disease, injury, treatment, medication list, or other medical record to purchase a product. However, because CBD products are often considered or used in connection with sleep, pain, stress, relaxation, and other health-related interests, certain product-interest, browsing, purchase, review, or support information may constitute or reveal Consumer Health Data under applicable law.

I. Inferences and Preferences

We may derive information such as likely product interests, shopping preferences, customer segments, purchase intent, advertising audiences, and product recommendations.

J. Reviews and User-Generated Content

If you submit a review, testimonial, photograph, survey response, promotion entry, or similar content, we may process the information contained in your submission. Information you intentionally make public may become publicly available.

K. Creator, Influencer, Affiliate, Retailer, and Partnership Information

If you apply to or participate in a CBD Pillow creator, influencer, affiliate, referral, retailer, wholesale, ambassador, reviewer, or other partnership program, we may collect information such as name, contact information, social-media handles and profiles, audience or engagement information, website or channel information, business or organization information, tax or payment information where necessary, affiliate or referral identifiers, program activity, commissions or other compensation, communications, and compliance information.

For example, when you purchase a product, create an account, contact customer service, request information, submit a form, use a recommendation feature, submit a review, participate in a promotion or survey, enroll in email or SMS marketing, make a return or warranty claim, or otherwise provide information to us.

We and providers supporting our Services may collect information through technologies such as cookies, pixels, tags, APIs, software development kits, local storage, server-side technologies, web beacons, device identifiers, log files, and similar technologies.

From Other Sources

We may receive information from service providers; advertising and analytics providers; attribution and affiliate partners; payment providers; delivery and fulfillment providers; fraud-prevention services; review and social platforms; creator, influencer, referral, retailer, wholesale, or marketplace partners where applicable; publicly available sources; another person acting at your direction; and other lawful business sources. We may combine information obtained from different sources where permitted by law.

If you purchase CBD Pillow products through a third-party marketplace or retailer, we may receive information permitted by that marketplace or retailer and applicable law, such as name, shipping information, order details, transaction status, customer-service information, return or warranty information, and marketplace identifiers. We use that information for fulfillment, service, fraud prevention, warranty, returns, legal compliance, and other purposes permitted by the applicable marketplace or retailer terms and law. A marketplace purchase does not by itself constitute consent to independent CBD Pillow promotional email or SMS marketing where separate consent is required.

Certain advertising-related activities may constitute "sale," "sharing," or processing for "targeted advertising" under applicable privacy laws even when CBD Pillow does not receive money for personal information.

Administering Creator, Affiliate, Retailer, and Partnership Programs

We may use program information to review applications; communicate with participants; provide products or promotional materials; issue or track referral links, codes, commissions, or incentives; administer wholesale or retailer relationships; prevent fraud or program abuse; evaluate performance; maintain tax, accounting, and payment records; comply with advertising-disclosure obligations; and otherwise operate the applicable program.

Security and Fraud Prevention

We may use personal information to authenticate activity, prevent fraud and abuse, detect suspicious activity, protect accounts, secure the Services, investigate unlawful conduct, and protect CBD Pillow, customers, and others.

Legal and Compliance Purposes

We may use personal information to comply with law, respond to lawful process, maintain tax and accounting records, enforce agreements, protect legal rights, investigate violations, comply with litigation holds, and establish, exercise, or defend legal claims.

Corporate Transactions

We may process or disclose information in connection with an actual or proposed merger, acquisition, investment, financing, restructuring, bankruptcy, sale of assets, or similar transaction.

5. ARTIFICIAL INTELLIGENCE AND AUTOMATED TECHNOLOGIES

CBD Pillow may use artificial intelligence ("AI"), machine learning, automated systems, recommendation technologies, generative AI, or AI-enabled services in connection with our business and Services.

These technologies may assist with answering customer questions; shopping and product-selection assistance; customer-service support; summarizing, categorizing, or routing communications; generating product recommendations; analyzing website or business performance; identifying patterns or trends; security and fraud detection; content assistance; improving business processes; and supporting internal operations.

Information provided through an AI-enabled feature may be processed by CBD Pillow and by service providers that provide, host, operate, or support the applicable technology.

Large Language Model Training

CBD Pillow does not sell personal data for the purpose of training large language models.

CBD Pillow does not use customer personal data to train general-purpose large language models for CBD Pillow.

We may permit providers to process personal information as reasonably necessary to provide AI-enabled functionality or services to CBD Pillow.

We do not authorize service providers acting on our behalf to use identifiable CBD Pillow customer personal information to train general-purpose artificial-intelligence or large-language models for their own independent purposes unless additional disclosure or consent is provided where required by applicable law.

This does not prevent legally permitted activities such as providing AI functionality requested by a customer; quality assurance; security; fraud prevention; evaluating system performance; improving CBD Pillow-specific workflows, configurations, retrieval systems, or customer-service processes; correcting technical errors; or using lawfully deidentified or aggregated information.

AI-Generated Information

AI-generated responses or recommendations may occasionally be incomplete or inaccurate. AI-enabled CBD Pillow features are not intended to provide medical, legal, financial, pharmacological, dosing, or other professional advice, and should not be relied on to determine whether CBD or another product is appropriate for a medical condition, medication regimen, pregnancy, drug-testing concern, or other health circumstance.

Automated Decision-Making

CBD Pillow does not use solely automated processing to make decisions concerning consumers that produce legal or similarly significant effects unless disclosed and permitted under applicable law.

6. COOKIES, PIXELS, ANALYTICS, AND ADVERTISING TECHNOLOGIES

CBD Pillow and providers supporting our Services use cookies, pixels, tags, APIs, server-side technologies, device identifiers, and similar technologies.

Necessary and Operational Functions

These technologies may support shopping carts, checkout, authentication, security, fraud prevention, remembering privacy preferences, and core website operation.

Analytics and Measurement

These technologies may measure visits, understand use of the Services, analyze product interest, identify errors, evaluate website performance, and measure advertising or conversion performance.

Personalization and Functionality

These technologies may remember preferences, support recommendations, customer-service or chat features, and website customization.

Advertising and Attribution

These technologies may attribute purchases or actions to advertising, measure campaign effectiveness, create or use advertising audiences, limit duplicate advertising, support relevant advertising, and measure conversions.

The particular providers and technologies we use may change over time. You may manage certain technologies through our website privacy controls, browser or device settings, or other legally recognized privacy mechanisms.

Certain technologies necessary for security, transactions, website operation, legally permitted measurement, or other non-targeted purposes may continue operating after you exercise an advertising-related opt-out where permitted by law.

7. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information to providers supporting ecommerce infrastructure, hosting and cloud services, payment processing, financing, fraud prevention, shipping and delivery, fulfillment, customer service, CRM, email and SMS services, communications, analytics, advertising and attribution, website optimization, recommendation technologies, AI-enabled services, cybersecurity, professional services, and other business operations.

Payment and Financing Providers

Information necessary to process a purchase or financing transaction may be processed directly by payment processors, financial institutions, financing providers, or fraud-prevention providers.

Advertising, Analytics, and Measurement Providers

We may disclose identifiers, commercial information, internet activity, device information, approximate location information, and related information to providers that support advertising, analytics, attribution, social-media advertising, or measurement. Some such activities may constitute sale, sharing, or targeted advertising under applicable law.

Delivery and Fulfillment Providers

CBD Pillow does not sell personal information to third parties in exchange for money.

As a result, disclosures through certain advertising, analytics, attribution, social-media, or similar technologies may constitute sale, sharing, or targeted advertising even where CBD Pillow receives no money for the information.

During the preceding 12 months, depending upon the technologies in use and your interaction with the Services, categories that may have been disclosed in a manner that may constitute sale, sharing, or targeted advertising include identifiers; commercial information; internet or electronic activity; approximate geolocation information; and inferences such as product interests, likely preferences, or advertising segments.

Recipient categories may include advertising platforms and networks, social-media platforms, analytics providers, attribution providers, advertising-measurement providers, and similar advertising technology providers.

Information We Do Not Intentionally Use for Targeted Advertising

  • passwords or authentication credentials;
  • full payment-card credentials;
  • Consumer Health Data;
  • medical diagnoses or health-condition information voluntarily provided to CBD Pillow;
  • the substantive contents of private customer-service communications for creating third-party advertising audiences; or
  • other information where applicable law prohibits such processing.

Your Privacy Choices

Residents of certain jurisdictions may have the right to opt out of sale of personal information, sharing for cross-context behavioral advertising, targeted advertising, and certain related profiling.

You may exercise applicable rights through the "Your Privacy Choices," "Do Not Sell or Share My Personal Information," or similar privacy-control mechanism available on our website.

Where required by applicable law, CBD Pillow processes qualifying browser- or device-based universal opt-out preference signals, including qualifying Global Privacy Control ("GPC") signals, as requests to opt out of applicable sale, sharing, or targeted-advertising processing.

A browser- or device-based signal generally applies to the browser, device, and associated pseudonymous profile through which it is received, and more broadly where required by applicable law and technically applicable.

Certain processing that does not constitute sale, sharing, or targeted advertising may continue following an opt-out, including processing reasonably necessary for requested products or services, transactions, website functionality, security, fraud prevention, privacy-preference management, legally permitted analytics or measurement, legal compliance, or other processing permitted by applicable law.

9. EMAIL, SMS, AND OTHER MARKETING COMMUNICATIONS

Promotional Email

Where permitted by law, CBD Pillow may send promotional email concerning our products, promotions, content, or offers. You may unsubscribe through the unsubscribe link included in a promotional email or by contacting us.

An unsubscribe does not prevent us from sending non-promotional communications reasonably necessary for our relationship with you, such as order confirmations, shipping and delivery communications, payment or transaction notices, return and refund communications, warranty communications, security notices, and customer-service responses.

We may maintain limited suppression information necessary to honor an unsubscribe request.

SMS and Text Messages

If you affirmatively enroll in a CBD Pillow SMS program, CBD Pillow and service providers acting on our behalf may use your telephone number and related information to administer that program in accordance with your consent and applicable law.

Promotional messages may include product information, offers, promotions, abandoned-cart or shopping-related communications, and other permitted marketing messages.

Consent to receive promotional text messages is not a condition of purchasing goods or services.

We may maintain records concerning when and how marketing consent was obtained, consent language, enrollment source, applicable contact information, unsubscribe or STOP requests, and suppression status.

10. RETENTION OF PERSONAL INFORMATION

CBD Pillow retains personal information for no longer than reasonably necessary and proportionate for the purposes for which it was collected or processed, subject to applicable legal, regulatory, contractual, security, fraud-prevention, accounting, tax, warranty, dispute-resolution, and litigation requirements.

Retention periods vary by category. We generally apply the following criteria:

Information may be retained longer where reasonably necessary because of a legal hold, investigation, dispute, litigation, regulatory requirement, fraud or security concern, warranty obligation, or other legally permitted need.

When information is no longer reasonably necessary, we may delete, destroy, deidentify, aggregate, or otherwise dispose of it in accordance with applicable law and our information-management practices.

11. SECURITY

CBD Pillow maintains administrative, technical, organizational, and physical safeguards designed to protect personal information in a manner reasonable and appropriate in light of the nature, volume, sensitivity, and circumstances of the information we process and associated risks.

Our security practices are designed to support the confidentiality, integrity, and availability of personal information and reduce reasonably foreseeable risks of unauthorized access, acquisition, use, alteration, disclosure, loss, or destruction.

We periodically evaluate and update security practices as appropriate in light of changes in our business, technology, legal requirements, risks, and information processed.

Where providers process personal information on our behalf, we may use contractual, diligence, or other risk-management measures appropriate to the relationship and information involved.

No Internet transmission, electronic storage method, network, system, or security measure can be guaranteed to be completely secure. We therefore cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of credentials associated with your account and notifying us if you believe your account or information may have been compromised.

12. U.S. STATE PRIVACY RIGHTS

Residents of certain U.S. states may have privacy rights under applicable law. Depending on your jurisdiction, the information involved, and statutory requirements or exceptions, these rights may include the right to:

Universal Opt-Out Preference Signals

Where required by law, CBD Pillow recognizes qualifying universal opt-out preference signals, including qualifying Global Privacy Control ("GPC") signals. We will treat a qualifying signal as a request to opt out of the sale, sharing, or targeted-advertising processing to which the signal legally applies.

We will not require you to provide additional identifying information solely to honor an applicable browser- or device-level opt-out signal. If a legally recognized signal conflicts with a prior CBD Pillow-specific preference permitting applicable sale, sharing, or targeted advertising, we will honor the signal to the extent required by law unless and until legally valid consent is subsequently provided.

Verification

For access, deletion, correction, portability, or other rights where verification is appropriate or required, we may take reasonable steps to verify your identity. We will request only information reasonably necessary to authenticate and process the request.

Where permitted by law, we may decline or limit requests where we cannot reasonably authenticate them, a statutory exception applies, the request is fraudulent or abusive, another person's rights would be adversely affected, or information must be retained for legally permitted purposes.

Authorized Agents and Appeals

Where permitted by law, an authorized agent may submit a request on your behalf. We may request reasonable evidence of the agent's authority and verify identities as permitted by law.

Where applicable law provides a right to appeal a privacy-request decision, an appeal may be submitted through the original request method or by emailing support@cbdpillow.com with the subject line Privacy Appeal. We will respond within the time required by applicable law.

Sensitive Personal Information and Non-Discrimination

Where applicable law provides enhanced protections for sensitive personal information, CBD Pillow will provide required consent, limitation rights, or other protections. Consumer Health Data is additionally addressed in our separate Consumer Health Data Privacy Policy.

CBD Pillow will not unlawfully discriminate or retaliate against you for exercising an applicable privacy right. This does not prevent lawful discounts, promotions, loyalty programs, or services that reasonably require particular information where permitted by law.

13. CONSUMER HEALTH DATA

Because CBD Pillow sells CBD-infused products and publishes content concerning sleep, relaxation, pain, stress, CBD use, absorption, dosage or microdosing, and related topics, information about a consumer's product interests, browsing, purchase history, intended use, reviews, or communications may constitute or reveal Consumer Health Data under applicable law depending on its content and context.

Consumers may also voluntarily disclose health conditions, symptoms, sleep difficulties, pain, anxiety or stress, medications, treatments, cannabis or cannabinoid use, CBD tolerance or dosing information, drug-testing concerns, pregnancy-related information, allergies or sensitivities, or other health-related information when contacting customer service, using chat or AI-enabled assistance, submitting a review or testimonial, making a return or warranty request, or otherwise interacting with CBD Pillow.

Certain product-view, purchase, communication, review, and health-related information may therefore constitute Consumer Health Data. We do not treat every visit to cbdpillow.com or every CBD Pillow purchase as proof of a medical diagnosis, but applicable law may regulate information that identifies or permits an inference concerning a consumer's health status or health-related interests.

CBD Pillow maintains a separate Consumer Health Data Privacy Policy describing the Consumer Health Data we may collect or receive, permitted purposes, categories of recipients, restrictions on sale and targeted advertising, consumer rights, and methods for submitting Consumer Health Data privacy requests.

The Consumer Health Data Privacy Policy applies to the extent required by applicable law and should be read together with this Privacy Policy.

14. CALIFORNIA PRIVACY

California residents should also review our separate California Privacy Notice, which supplements this Privacy Policy and provides the California-specific disclosures required by the California Consumer Privacy Act, as amended.

15. CHILDREN AND TEENS

The Services are intended for an adult audience and are not directed to children. CBD Pillow does not knowingly design its CBD-product marketing to solicit children to purchase or use CBD products.

CBD Pillow does not knowingly collect personal information online from children under 13 in circumstances where the Children's Online Privacy Protection Act requires verifiable parental consent unless the required consent has been obtained.

If we learn that we collected personal information from a child under 13 in violation of applicable law, we will take reasonable steps to address or delete the information as required.

Minors
